Jennifer Kilinski

Jennifer Kilinski is a Founding Partner at Kilinski | Van Wyk where she specializes in the establishment and representation of special districts, including community development districts, improvement districts, stewardship districts and recreational districts. She also represents private and public clients in construction law matters and serves as issuers counsel and, when not representing the district, developers counsel in conjunction with public financing matters.

Jennifer began her legal career with Hopping, Green & Sams P.A. where she spent 12 years, advanced to partner, and earned her reputation as a key contributor in growing the firm’s credibility and position in representation of developers, landowners, home builders and others in the establishment and general counsel representation of various categories of special districts, including CDD’s, throughout the state of Florida. Jennifer has always had a keen interest in the business side of the law and came to the realization that there was a more efficient operating model, resulting in the formation of Kilinski | Van Wyk PLLC, a boutique specialty law firm providing big law experience without the bureaucracy, overhead, and attitude. Jennifer’s focus is specific to advising clients in the establishment and continuing operation of community development districts and other forms of special taxing districts – Jennifer helps clients in the areas of public finance, public procurement, open government (Sunshine Law) and ethics, rulemaking procedures, construction matters, navigating various licensing requirements, real property transactions, election law, government contracts, and a wide array of District governing documents. She’s been instrumental in helping achieve District goals by influencing legislative changes in the interests of special districts and listening to the client’s policy goals and challenges and coming up with business and legal solutions to achieve positive outcomes. She also represents clients on business and governmental regulation matters, including, but not limited to: construction law issues including contract negotiations, in bidding matters, including bid protests, in default situations, including foreclosure and bankruptcy, and in procuring alcohol and other licenses before the states licensing boards, including the Department of Business and Professional Regulation.

Public Finance – Jennifer has led a number of projects to assist her clients on developing public finance strategy to meet their needs. Having served over 100 different special district projects across the state of Florida she is well equipped to provide sound guidance on construction, acquisition, strategy, and execution for multiple types of community infrastructure and development financing needs. Her clients include a broad assortment of districts, from thousands of acres and units to a few hundred homes, with varying goals. All projects are complex and having the right legal advice is a must when considering issuing bonds and creating alternate financing arrangements for funding water and sewer systems, public roadways, transportation improvements, drainage projects, and parks and recreation, among other public projects. Jennifer also has experience in the restructuring and reissuance of bonds.

Issuers Counsel – Having provided counsel on hundreds of millions in bond issuance value across multiple clients in a fast-growing segment of her practice, Jennifer is known across the state of Florida for her competence as Issuers Counsel.

Developers Counsel – Jennifer has provided direct service to developers and landowners on public financing matters, including review of financing documents, underwriter disclosures and related matters.

Landowner and Developer Services – Jennifer has provided clients with advice on all phases of landowner, developer, home builder and resident development activities and has a passion for bringing projects to life. From greenfield to residential launch and beyond, she’s been involved in significant projects guiding teams to the right strategy to achieve success with the least risk possible.

Experience Highlights

  • Jennifer represents some of the largest master planned communities in Northeast Florida, Central Florida, Southeast Florida and areas in between.
  • Jennifer has served as counsel to some of Florida’s largest landowners, national homebuilders, and largest developers in the establishment of special districts and general counsel representation thereafter. This representation includes serving as district counsel in the validation of hundreds of millions of dollars in tax-exempt financing and serving as issuer’s counsel related to the same.
  • Jennifer also represents a large number of resident controlled special districts, where she prides herself on offering policy, business and legal advice in support of the elected officials direction and goals. She understands the importance of sound policy and supporting legal advice and the direct impact to people’s lives in their communities. She walks hand in hand with newly elected officials in support of their policy goals.
  • Jennifer has provided legislative services to industry organizations and special district clients, including monitoring legislation, participating in executive and legislative branch lobbying on special district issues and coordinating large scale efforts, including the implementation of Amendment 12.
  • Jennifer represents a number of private landowners in conjunction with negotiation and execution of construction contracts for multi-million dollar private projects, including coordination with owners, contractors, engineers and related professionals.

In her free time, Jennifer is action oriented – she enjoys spending time with her husband and their extremely active children, working on community and civic projects especially with at risk populations and training for and competing in triathlons and other outdoor pursuits.
